On the Scene of a DUI

When a police officer pulls someone over for a DUI, he or she may have witnessed the driver commit a crime, or perhaps the officer noticed unusual driving. Whatever the case, there is protocol to follow. Most likely, the officer will begin by asking the driver questions about his or her night.

After Being Pulled Over

The officer may next conduct a field sobriety test. Field sobriety tests could involve walking in a straight line, standing on one leg, and observing eye movements. The officer may also conduct a Breathalyzer test, which tests for Blood-Alcohol Content (BAC). If a BAC is found to be above the state limit, the officer will arrest the driver. The driver will be notified of the arrest as it is happening, as well as his or her rights. In Florida, the implied consent law means that all licensed drivers are required to take a Breathalyzer test if they are arrested for a DUI.
