Driver Blew .214 & .220 Breath Test; Arrested & License Suspended

Driver’s License Reinstated!

The Charges

Officers witnessed a driver take a turn too fast and hit a guardrail head-on. The vehicle had extensive damage, including a raised hood that blocked the driver’s line of vision. The officer initiated a traffic stop, and the suspect exhibited signs of intoxication. The Driver admitted to drinking at a local nightclub prior to the crash. The Driver failed field sobriety exercises and possessed a blood alcohol content of .214% & .220%, which are far over the legal driving limit. Officers arrested the Suspect for DUI (Driving Under the Influence), resulting in a suspended driver’s license.

Formal Administrative Hearing

After one has been charged with a DUI, it is important that they set up a formal administrative hearing. If you have charged with driving under the influence, your driver’s license will be suspended for a long time depending on if it was your first offense, second offense, or a subsequent offense. An individual has only 10 days to request this hearing, so it is imperative that this is done as soon as possible after the arrest. An experienced criminal defense attorney will help you fill out the correct paperwork to get the process rolling.

With a formal administrative hearing, you may still have your driver’s license suspended. However, it will only be for a short period of time, such as 30 days. This is much better than having your license suspended for a year or more.
