What is the Difference Between Serious and Non-Serious Bodily Injury in the State of Florida?

Depending on the skill of your attorney and the facts of your DUI case, you might be criminally charged with a lighter or heavier jail sentence. This determination is generally dependent on how severe the victim's injuries are. If the victim's injuries are not that severe or life-threatening, the defendant may be charged with a misdemeanor instead of a felony.

How Florida DUI Laws Defines "Serious Bodily Injury"

Florida Statutes Section 316.193(3) explains how the prosecution must prove three factual elements to win a conviction in a DUI with Serious Bodily Injury criminal case. The three factual elements that must all be "proven beyond a reasonable doubt" to obtain a conviction include:

  1. The accused (defendant) was driving, drove, or was in physical control of a motor vehicle.
  2. The accused was under the influence of alcohol or drugs to such an extent that the driver's normal faculties were impaired, or the driver submitted to a chemical test, and the results of the blood alcohol content (BAC) test was 0.08% or higher, at the time the driver was in control of the motor vehicle or driving.
  3. As a consequence of driving the motor vehicle, the defendant caused or helped cause an accident leading to serious bodily injury of another.

For the injury to be considered a serious injury, the injury must have been life-threatening, placed the victim at significant risk of death or at substantial risk of receiving serious disfigurement or created a significant risk of losing or impairing the function of an organ or a body part.
