VERO BEACH - May 8, 2020 - According to an online news report posted on TheSmokingGun.com, a 56-year-old woman was arrested by the Indian River County Sheriff's Department for exposing her breasts in public, according to the woman´s arrest affidavit report. The arrest affidavit states that the woman was topless while cleaning her garage. The police report alleges the woman was in full view of the woman´s neighbors, and the woman asserted her actions were not unlawful.

The Indian River County Sheriff's Department received a 911 phone call concerning a woman who was exposing her sexual organs. Law enforcement officers spoke with one of the suspect´s neighbors who lives directly across the street from the suspect. The Case Report # 2020-00074379 states that a witness claims the suspect pulled down her top down and exposed her breasts to the victim and her children. The report states the minor children range in age from five to eleven years of age. The report also alleges the suspect was topless and drew attention to herself by pounding on a recycling bin. The neighbor stated that the suspect want to make sure her and her children "were looking.”

The news article states that when the Indian River County sheriff's deputies made contact with the suspect was seen with her tank top tucked under her breasts and Deputy David Ragley stated that he could see the suspects breasts. The news report alleges that the sheriff's deputies order the suspect to cover up her bare chest but the suspect refused stated that she didn’t have to cover her bard chest while in her garage. The suspect eventually pulled up her top and covered herself. The sheriff's deputies explained to the suspect that it is against the law to be topless and in view of her neighbors. The suspect was placed under arrest for exposing her sexual organs in public.

The suspect´s charge is a misdemeanor in the state of Florida. She posted a $500 bail bond and a judge ordered the her to not have any contact with the victims. The suspect´s arraignment hearing is scheduled for June 2, 2020.

According to Florida Statute 800.03 – Exposure of Sexual Organs, it is a crime in the state of Florida for an individual to exhibit or expose their sexual organs in public. It is also violation of the law for an individual to expose their sexual organs with a private premise in such a way that their sexual organs may be seen by others who are out in public. Exposure of sexual organs is a first-degree misdemeanor in Florida. In the state of Florida, a mother who is breastfeeding her baby in public is not violating the law.
