For a qualifying refusal, the administrative suspension is generally one year for a first refusal and 18 months when the driving privilege has previously been suspended for a qualifying refusal.

These administrative periods should not be confused with license consequences that may result from a later criminal DUI conviction.

What Is The 10-Day DUI License Deadline?

Section 322.2615 permits the driver to request formal or informal review within 10 days after issuance of the suspension notice.

That deadline is one reason I recommend addressing the license case immediately.

A person's criminal arraignment may occur later. The administrative deadline does not wait for the criminal court schedule.

What Is A Formal Review Hearing?

At a formal review, evidence and witnesses may be considered concerning the administrative suspension. Florida's review paperwork identifies issues that can include whether the officer had probable cause to believe the person was driving or in actual physical control while under the influence and, depending on the case, whether an unlawful alcohol level existed or whether the person refused after receiving the required warning.

A formal review can provide more than an opportunity to contest the suspension. Testimony and evidence developed during the process may also help me understand the criminal case.

I can compare officer testimony with reports, video, and later testimony. Material inconsistencies can become important.

Whether formal review, informal review, or another available option is best depends upon the individual case.

What Is An Informal Review?

An informal review generally involves examination of submitted documents rather than live witness testimony. FLHSMV describes the informal process as an examination of materials submitted by the driver and law enforcement.

The choice between formal and informal review should be strategic.

A case with important factual disputes may present different considerations from a case involving a narrow documentary defect.

I would review the arrest and license history before deciding which approach makes sense.

Can A First-Time DUI Driver Seek A Restricted License?

FLHSMV states that certain first-time DUI offenders with no prior DUI-related offenses may be eligible to request a review for a restricted driver's license. Choosing that route can involve waiving the right to challenge the suspension.

That tradeoff deserves careful consideration.

Immediate restricted driving can be valuable for someone who depends on a vehicle for employment, but giving up a challenge to the suspension may have consequences.

I would compare the strength of the administrative defense against the need for driving privileges before recommending an approach.

Does Winning The License Hearing Dismiss The DUI?

No. The administrative case and criminal case are separate.

A favorable administrative result can restore or protect driving privileges, but prosecutors may still pursue the criminal DUI charge.

Likewise, an unfavorable administrative result does not prove guilt in criminal court. The State still carries the burden of proving DUI beyond a reasonable doubt.

That distinction is important because people sometimes believe losing one proceeding means the entire case is lost. It does not.

Can A Private Tampa Florida Criminal Defense Attorney Challenge The Suspension?

Yes. The available challenge depends upon whether the suspension was based on an unlawful alcohol level or refusal.

Potential issues can include the legality of the stop, probable cause, whether the driver was actually driving or in actual physical control, the validity of the chemical test, and whether proper refusal warnings were given.

In a refusal case, I would also determine whether the evidence actually establishes refusal.

The officer's report may say "refused," while video could show attempted compliance or confusion. The administrative case should be based on evidence, not a checkbox.

What Happens If You Miss The 10-Day Deadline?

Failing to request review within the statutory period can result in waiver of the right to that administrative review. FLHSMV expressly warns that the formal or informal review request generally must be submitted within 10 days.

There may still be other licensing issues or avenues to examine depending on the circumstances, but the missed deadline can remove an important opportunity.

This is why I do not recommend waiting to see what happens in criminal court before addressing driving privileges.

Consider an illustrative Tampa case in which a driver receives a six-month administrative suspension after a breath result above 0.08. The officer reports that the driver was speeding and showed signs of impairment.

I request a formal review and obtain the relevant records. Suppose the patrol video shows that the alleged speeding determination is unsupported and that the officer's narrative concerning driving behavior differs from the recording.

I also examine the breath-testing documentation and discover a procedural issue that may affect whether the State can rely on the result.

Those facts could provide grounds to challenge the administrative suspension while also strengthening the criminal defense.

The administrative hearing and criminal case would still be handled separately, but evidence developed in one may help expose weaknesses in the other.

The breath result can still be challenged in the criminal and administrative contexts where legal or technical grounds exist.

Potentially, depending on the administrative result and your eligibility for available driving privileges.

The criminal prosecution and administrative license case proceed independently, so you do not necessarily have to wait for the criminal case to finish before addressing the suspension.
