A 47-year-old Hialeah man has been arrested for allegedly assaulting a female patient at a Miami medical center. According to a news report in The Huffington Post, the former nurse technician was arrested following an incident at Kendall Regional Medical Center in Miami.

Officials say the woman was at the hospital for surgery when the man allegedly sexually assaulted her. This allegation surfaced after the man was already fired and arrested on suspicion of raping a female patient in a hospital room on August 2. He claims that the sex was consensual.

Rape is known as sexual battery under Florida law, but any non-consensual sexual activity can result in sexual battery charges. This includes all sex acts that result from coercion, incapacitation, or force. Under Florida Statute 794.011, consent means “intelligent, knowing, and voluntary consent and does not include coerced submission.” The prosecution will have to prove that a sexual act occurred and that the activity was not consensual.

Sexual abuse in Florida is a felony that carries a mandatory prison sentence. These types of cases often involve multiple charges that could result in life without parole. Additionally, those convicted will have to register as a sex offender or sexual predator for the rest of their lives. Registered sex offenders often struggle to obtain jobs or even repair their tarnished reputation among their peers and neighbors.
