NOISE COMPLAINT RESULTS IN FELONY DRUG ARREST

CASE RESOLVED IN ONE DAY!

The Charges

Police arrived on the scene of a noise complaint. The officers smelled marijuana and asked the suspect if there was any inside the home. The defendant handed the officers 30 grams of marijuana hidden from inside the kitchen. Officers arrested the defendant and charged him with felony drug possession.

Felony Drug Possession

In Florida, drug charges are very serious with strict penalties. It is a felony in the third degree for possession of 20 grams or more of marijuana. This is penalized by up to 5 years in prison, a fine of $5,000, or both.

The prosecution will need to prove the following elements beyond a reasonable doubt:

  • The prosecution will need to prove that the amount of drugs found were illegal and are a controlled substance.
  • The prosecution will need to prove that the defendant had knowledge that the illegal drug was in their possession.
  • The prosecution will need to prove that the defendant had control over the controlled substance.

Other Consequences of Felony Drug Possession

In addition to the penalties listed above, a person will face many other consequences for a felony drug possession charge, including the following:

  • Inability to obtain employment at various places
  • Ineligible for public housing
  • Probation period
  • Suspension of driver’s license
  • Turned down by certain colleges
  • Inability to obtain a state license for some professions
  • You may not be eligible for financial aid or scholarships
  • Ruining your reputation

You will have to mark the box on applications asking if you have ever been convicted of a felony. Landlords have the right to not accept you as a tenant. If you lie about this, you will face further penalties and consequences.
