A state law that was put into place two years ago is now being implemented in Florida. Drug dealers have been placed in jail for possessing and selling illegal drugs in the past. Now, however, these drug dealers that are selling or possessing fentanyl could now face murder charges.
Fentanyl is a prescription drug that is a painkiller. It is a synthetic opioid with a high potential for addiction and dependence. It is very deadly when combined with other illegal drugs and alcohol.
Many with moderate to severe pain are prescribed fentanyl typically after surgeries. It is similar to morphine but much more powerful. In fact, it is anywhere from 50 to 100 times more potent. It is 50 times more potent than heroin. It is commonly abused by drug users who want a stronger high.
Leading Causes of Death
The Medical Examiner’s Commission in Florida is now saying that fentanyl is one of the leading causes of death in drug overdoses besides cocaine. The law has been passed due to very high numbers of deaths. Just last year (2018), it was reported that in the previous year of 2017, there were 1,743 deaths of this drug. The numbers increased from 2016 where the number was 1,390. In 2015, there were 705 deaths due to fentanyl.
Florida’s New Drug Law
If a drug dealer’s customer uses fentanyl that they sold this person, and he or she dies, the drug dealer could face murder charges. The law also states that anyone that has in their possession 4 grams of fentanyl or similar drug carfentanil will spend at least three years behind bars. Carfentanil is 100 times more potent than fentanyl. Anyone that is caught with 14 or more grams of fentanyl will spend a minimum of 15 years locked up, while those with 28+ grams would spend 25 years at a minimum in prison.
Lawmakers are very serious about fentanyl charges, feeling it is a weapon just as a gun is. Overdoses may be accidental, but in many situations, they are not considered to be accidental. Governor Rick Scott states of the strict law: "I'm proud to sign this important piece of legislation today to help fight this national epidemic, which has taken the lives of too many Floridians."
